Definition: Death claim

If your loved one has passed away while on the job then you are eligible to file a death claim to the workers compensation insurance company. If you are classified as a dependent of the person who died then you have the right to make a claim. A dependent means a spouse, child, grandchildren, parents, siblings, grandparents, aunts, uncles, nieces, and nephews. If you fit into any of these categories then you are able to file a death claim. If you are a child under the age of 18, an adult child unable to earn a living, or a spouse who earned $30,000 or less then you are automatically a total dependent. Otherwise, you have to prove that you are a dependent.

Once you are eligible, the claim must be filed within one year of the employee’s death due to work-related injury or illness. Most plans cover up to $320,000 for three or more total dependents. However, if you are a partial dependent then you are still eligible for benefits. Workers Compensation company insurance should also pay for reasonable burial expenses up to $10,000.
